MyCenturaHealth Terms and Conditions of Use

MyCenturaHealth is an online service offered by Centura Health Corporation to allow You online access to Your personal medical information and the ability to communicate online with Your health care providers. By accessing or using MyCenturaHealth, You confirm that You have fully read, understand and agree to MyCenturaHealth Terms and Conditions of Use, including but not limited to, the additional terms and conditions specific to such services as E-Visit and Video Visit ("Terms of Use"). If You do not agree to the Terms of Use, You will not be permitted to use MyCenturaHealth. Throughout the Terms of Use, Centura Health Corporation is referred to as "Centura Health", "We", “Our” or "Us". Individuals accessing or using MyCenturaHealth are referred to as "You", "Your", or "User(s)".

Purpose of MyCenturaHealth

MyCenturaHealth allows You another option to access Your medical information and communicate with Your health care providers. MyCenturaHealth allows You to view certain medical information online in a secure manner, including, but not limited to, selected portions of Your medical record and summary health information, current medications, allergies, immunizations, histories, and test results as released by Your physician. MyCenturaHealth also provides a method to communicate with certain health care providers to allow You to: (1) receive important health reminders, (2) request prescription refills and renewals, and (3) communicate with Your health care providers about non-urgent medical issues.

MyCenturaHealth is not intended to be used to address medical emergencies. IF YOU ARE EXPERIENCING AN EMERGENCY OR URGENT MEDICAL PROBLEM, GO TO THE NEAREST EMERGENCY ROOM OR CALL 9-1-1 OR YOUR PHYSICIAN'S OFFICE IMMEDIATELY .

Your Account Profile, User ID and Password

Prior to Your initial log into MyCenturaHealth, You must review these Terms of Use and create a personal profile account. You may only provide information that You own or have the right to use when You create, transmit, or display health or any other information while using MyCenturaHealth. You represent and warrant that all information You provide or supply to Centura Health through MyCenturaHealth, including without limitation, information contained in Your personal profile, is accurate and complete. You are responsible for maintaining the confidentiality of all user identification, password and other confidential information relating to the use of Your account and are fully responsible for all activities that occur under Your account. You are responsible for taking all reasonable steps to ensure that no unauthorized person accesses Your account. You must promptly notify Centura Health of any unauthorized use of or access to Your MyCenturaHealth account. Centura Health assumes no responsibility or liability for any information that You transmit, receive from or submit to MyCenturaHealth, or for any use or misuse by You or third parties who You authorize.

Medical Records

You may have the opportunity to access healthcare records and information through MyCenturaHealth ("Your Records"). You hereby grant Centura Health, its employees, officers, directors, agents and contractors, and all other persons or entities involved in the operation of MyCenturaHealth, the right to access, transmit, receive, monitor, retrieve, store, maintain and use Your Records in accordance with Centura Health's Notice of Privacy Practices. You are responsible for reviewing Your account information as well as any documents produced by Centura Health.

Minor Eligibility

An individual must be age 18 or older to request a MyCenturaHealth account. Parents or legal guardians of minor children may request access to the minor child's account by following the terms outlined in the "Proxy Access" section set forth below.

With parental or legal guardian written consent, minor children between the ages of 13 and 17 (inclusive) will be able to access MyCenturaHealth. Under State and Federal law, there are certain types of medical information that the parent or legal guardian of a minor patient ages 13-17 may not view without the written consent of the minor patient. Because of these requirements, adolescents between the ages of 13-17 may only create a MyCenturaHealth account once the parent or legal guardian has provided written consent. This consent by the parent or legal guardian allows Centura Health to regard the adolescent as an adult. The consent provided by the parent or legal guardian allows the adolescent to have his/her own MyCenturaHealth account.

When a minor patient reaches age 13, restrictions will be placed on MyCenturaHealth access until he/she reaches age 18 or until consent for the adolescent to have a MyCenturaHealth account has been signed by a parent or legal guardian and the adolescent activates his/her account. Adolescents may grant parents or legal guardians' proxy access to their MyCenturaHealth account by following the terms outlined in the "Proxy Access" set forth below.

Proxy Access

Individuals age 18 or older may request proxy access to another individual's MyCenturaHealth account by successfully completing a Proxy Access Authorization Form and submitting it to Centura Health. Individuals age 13-17 may grant Proxy Access to parents or legal guardians by completing the Proxy Access Authorization Form and submitting it to Centura Health. All medical information that is made available in MyCenturaHealth will also be made available to Your Proxy. Such access will only be granted to parties with parental rights or legal guardianship over the MyCenturaHealth account holder and only to the extent that the party requesting proxy access can demonstrate their legal right to account holder's medical information. A MyCenturaHealth account will be activated for both the proxy and the account holder. If the proxy's legal relationship with the account holder changes, the original account holder must inform Us immediately, or send written notice to Centura Health. Centura Health reserves the right to revoke proxy access at any time for any reason. A minor who allows the parent or legal guardian to access the minor's account is permitting the parent/guardian access to information that may be confidential under State and federal law . A minor who allows the parent or legal guardian to access the minor's account is voluntarily disclosing such confidential information to the minor's parent or legal guardian and Centura Health shall not be liable for any breach of confidential information in such circumstance.

Communication

If You elect to use MyCenturaHealth, it may be used by Your health care providers to communicate selected test results and other important medical information to You. If You opt in, You may also receive SMS messages regarding activity in connection with Your MyCenturaHealth Account (see Additional Terms and Conditions: SMS Messaging Services below for more details). Centura Health assumes no responsibility for how You use the information You obtain from MyCenturaHealth. You should direct any questions You have about the data available to You in MyCenturaHealth to Your physician or other healthcare provider.

You should not use MyCenturaHealth to send messages regarding matters requiring urgent attention . While reasonable efforts will be made to provide a timely response to communications through MyCenturaHealth, Centura Health cannot guarantee a specific time frame for a response or that any response will be provided. Delays can occur based on the volume of messages and technology outside of Centura Health's control. At times, the clinic staff or personnel needed to respond to Your message may not be available, so You should allow at least two (2) business days for any response. For these reasons, You should not use MyCenturaHealth to communicate with Centura Health or Your healthcare provider in urgent situations. For all urgent medical matters, contact Your physician's office directly, or go directly to an emergency room or call 911.

Centura Health is only able to respond to electronic communications based on the information You provide. If You provide insufficient information, Centura Health will be unable to provide an accurate or reliable response.

Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT CENTURA HEALTH SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR INJURY, ILLNESS, DISABILITY, LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF CENTURA HEALTH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) YOUR USE OR YOUR INABILITY TO USE MYCENTURAHEALTH; (ii) THE COST OF PROCUREMENT OF SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICES; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON MYCENTURAHEALTH; (v) YOUR USE OF THE INTERNET OR YOUR INTERNET SERVICE PROVIDER; (vi) DEFECTS OR INACCURACIES IN YOUR COMPUTER HARDWARE OR SOFTARE, OR ANY OTHER DEVICE USED TO ACCESS MYCENTURAHEALTH OR THE SERVICES; OR (vii) ANY OTHER MATTER RELATING TO YOUR USE OF MYCENTURAHEALTH. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF CENTURA HEALTH EXCEED THE TOTAL AMOUNT OF FEES PREVIOUSLY PAID BY YOU TO CENTURA HEALTH RELATING TO THE YOUR USE OF MYCENTURAHEALTH. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

ANY INFORMATION CONTAINED ON MYCENTURAHEALTH OR PROVIDED THROUGH MYCENTURAHEALTH IS PROVIDED ON AN "AS IS" BASIS ONLY AND IT IS NOT INTENDED, OR TO BE CONSTRUED, AS MEDICAL ADVICE, DIAGNOSIS AND TREATMENT, AND IS NOT A SUBSTITUTE FOR CONSULTATIONS WITH QUALIFIED HEALTH PROFESSIONALS WHO ARE FAMILIAR WITH YOUR INDIVIDUAL MEDICAL NEEDS. WE WILL REGARD ALL ACCESS TO AND USE OF MYCENTURAHEALTH AS VOLUNTARY AND AT YOUR SOLE RISK. Modifications and Updates

Centura Health reserves the right to modify, amend and update these Terms of Use at any time by posting amended Terms of Use on MyCenturaHealth. Any updates to these Terms and Conditions of Use will be posted on MyCenturaHealth, from time to time. You acknowledge and agree that it is Your responsibility to review these Terms of Use from time to time and to be aware of any such changes. Your use of MyCenturaHealth after such posting constitutes acceptance by You of the revised Terms of Use.

Proprietary Rights

The materials on MyCenturaHealth are copyrighted by Centura Health and/or other applicable rights holders. You acknowledge and agree that MyCenturaHealth and any necessary software used in connection with MyCenturaHealth contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that any content contained in sponsor advertisements or information presented to You through MyCenturaHealth or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws.

Indemnity

You agree to release, indemnify and hold Centura Health, and Our directors, officers, physicians, employees, agents and third party licensors harmless from and against any and all liabilities, losses, damages, claims, and expenses, including reasonable attorneys' fees, with respect to (a) any and all injury, disability, death or damage to property (tangible or intangible) arising from or relating to Your use of MyCenturaHealth; (b) any infringement or violation of any intellectual property rights arising from or relating to Your use of MyCenturaHealth (including any content); (c) any breach of Your representations or obligations under this Agreement; and (d) any activity that occurs under Your User ID and password.

MyCenturaHealth Use Rights and Restrictions

Subject to the terms and conditions outlined in this Agreement, Centura Health grants to You a personal, revocable, non-assignable, non-sublicensable, and non-exclusive limited right to (i) use MyCenturaHealth and (ii) view all content provided, made available or otherwise accessible via MyCenturaHealth. Except as expressly authorized by Centura Health or advertisers, You agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on MyCenturaHealth, in whole or in part. You may download and reprint a single copy of the materials from MyCenturaHealth for Your own personal, noncommercial use only, provided You include all applicable notices and disclaimers. You agree not to modify MyCenturaHealth in any manner or form, or to use modified versions of MyCenturaHealth, including (without limitation) for the purpose of obtaining unauthorized access to MyCenturaHealth. You agree not to access MyCenturaHealth by any means other than through the interface that is provided by Centura Health for use in accessing MyCenturaHealth. You shall not, in whole or in part, adapt, translate, modify, decompile, reverse engineer, or disassemble MyCenturaHealth, merge MyCenturaHealth into other program material, nor shall You otherwise create or attempt to obtain the source code of MyCenturaHealth.

Governing Law and Venue

If services are performed in the State of Colorado, this Agreement shall be governed by and shall be construed in all respects under the laws of the State of Colorado, exclusive of its choice of law or conflict of laws provisions. If services are performed in the State of Kansas, this Agreement shall be governed by and shall construed in all respects under the laws of the State of Kansas, exclusive of its choice of law or conflict of laws provisions.

In all respects, in any claim or action by You directly or indirectly arising under this Agreement or related to Your use of MyCenturaHealth, You irrevocably agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Arapahoe County, Colorado. You waive any jurisdictional, venue or inconvenient forum objections to such court. If any of the provisions of this Agreement are held to be unenforceable by a court or other tribunal of competent jurisdiction, then such provisions shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.

Rights, Remedy, and Termination

Centura Health may, in its sole discretion, terminate Your access to MyCenturaHealth, or any portion thereof, or discontinue providing MyCenturaHealth, or any portion thereof. Centura Health may notify You that You have breached this Agreement and Your account is being terminated. These actions are in addition to and not in lieu or limitation of any other right or remedy Centura Health may have available at law. Further, Centura Health shall not be liable to You or any third party for any such termination or discontinuance.

MyCenturaHealth may contain links to websites operated by other parties. Centura Health does not sponsor, operate, control, or endorse any of these sites, nor the information, products, or services provided by third parties through the Internet, nor does Centura Health make any guarantee, warranty, or representation regarding the accuracy of the information contained on the websites. Centura Health has no control over the security or privacy practices of these external websites. Use of other sites is strictly at Your own risk. You are responsible for viewing and abiding by the terms and conditions of use and the privacy statements of such other websites.

Additional Terms and Conditions for MyCenturaHealth Alerts (SMS Messaging Service)

Program Description . MyCenturaHealth Alerts allow mobile subscribers to opt-in to receive alerts about their MyCenturaHealth account through SMS text messages on their mobile phones.

Cost . There are no premium charges for receiving MyCenturaHealth Alerts; however, standard message and data rates may apply.

Supported Carriers . Alltel, Appalachian Wireless, AT&T, Bluegrass Cellular, Boost Mobile, Cellcom, Cellular South, Centennial Wireless, GCI, Immix Wireless, Inland Cellular, IV Cellular, Nex-Tech Wireless, nTelos, Metro PCS, Sprint, T-Mobile, U.S. Cellular, United Wireless, Verizon Wireless, Virgin Mobile USA, and West Central Wireless.

T-Mobile is not liable for delayed or undelivered messages.

Message Frequency . If You opt-in to receive alerts or information from MyCenturaHealth, You will receive one SMS message on Your mobile phone each time You have a new message in Your MyCenturaHealth account.

How to Opt-Out of SMS Messaging Service . To opt-out of receiving messages from MyChart, You must log into Your MyCenturaHealth account, select the Preference tab and deselect the Alert Type under Notification Settings which You do not wish to receive. If You have sent a command in MyCenturaHealth to opt-out and have questions about whether it has been processed, please contact Centura Health using the information in “Support/Help” below.

Privacy Policy . Centura Health will use Your information in compliance with applicable state and federal laws. For more information on how Centura Health uses Your information, please view our complete Notice of Privacy Practices .

Additional Terms and Conditions for E-Visit

IF YOU ARE A RESIDENT OF COLORADO, EACH TIME YOU THE USE E-VISIT SERVICE, YOU UNDERSTAND AND AGREE THAT YOU MUST BE PHYSICALLY LOCATED IN THE STATE OF COLORADO, AND YOU ACKNOWLEDGE THAT YOU ARE PRESENTLY LOCATED IN THE STATE OF COLORADO. E-VISIT MAY NOT BE USED IF YOU HAVE MOVED OR RESIDE OUTSIDE THE STATE OF COLORADO.

IF YOU ARE A RESIDENT OF KANSAS, EACH TIME YOU USE THE E-VISIT SERVICE, YOU UNDERSTAND AND AGREE THAT YOU MUST BE PHYSICALLY LOCATED IN THE STATE OF KANSAS, AND YOU ACKNOWLEDGE THAT YOU ARE PRESENTLY LOCATED IN THE STATE OF KANSAS. E-VISIT MAY NOT BE USED IF YOU HAVE MOVED OR RESIDE OUTSIDE THE STATES OF KANSAS.

Use for Non-Urgent Conditions . E-Visits should only be used to request medical care for certain non-urgent conditions. You should not attempt to seek emergency care through E-Visits. If You have an urgent need to seek medical attention, You should contact Your provider's office by phone, or for medical emergencies, call 9-1-1.

Consent for Care . You consent to receive medical care from Your provider via the E-Visit option. The scope of care will be at the sole discretion of Your provider, and You understand that there are limitations to the care that can be provided through E-Visits. You also understand that E-Visits do not take the place of an in-person appointment. You understand that if Your provider is unable to treat Your concern through an E-Visit, You should come to Your provider's office for an in-person visit.

Refusal of Treatment . You understand that if You refuse treatment that is suggested by Your health care provider or You do not complete a treatment protocol recommended to You by Your health care provider, You will not hold Centura Health liable for the consequences of Your refusal or decision not to complete Your recommended treatment.

Location . You understand that You are responsible for ensuring Your privacy from others at Your location during Your E-Visit, and You affirm that You will take precautions to ensure that Your E-visit cannot be viewed by others near You without Your permission.

Privacy Notice . You understand that the contents of Your E-Visit (messages between You and Your provider as well as information that You have entered concerning Your condition) will become a part of Your medical record. You authorize Centura Health to disclose copies of all or any part of Your medical records obtained in the course of Your diagnosis and treatment from Your E-Visit in accordance with Centura Health's Notice of Privacy Practices.

Content of Communications . You understand that You are responsible for Your communications during Your E-Visit. You will not:

 communicate material that is obscene, defamatory, threatening, abusive or hateful

 communicate sexually-explicit images

 impersonate another person

 violate the Children's Online Privacy Protection Act (COPPA)

 communicate material that is copyrighted, without the permission of the copyright holder

 communicate material that infringes on any other intellectual property rights of others or the privacy or publicity rights of others

Payment.

E-Visits.

Financial Responsibility : Subject to applicable law and the terms and conditions of any applicable contract between Centura Health and a third-party payer, and in consideration of all health care services rendered or about to be rendered to You, You agree to be financially responsible and obligated to pay Centura Health for its total charges not paid under the "Assignment of Benefits" made below. All other balances must be paid within thirty (30) days after receipt of a statement. You understand that You will be responsible for the costs of any services rendered to You that are not eligible for benefits under Medicare, Medicaid, insurance or other payors.

Assignment of Benefits/Third-Party Payers : In consideration of all health care services rendered or about to be rendered to You, You hereby assign to Centura Health all right, title, and interest in and to any third-party benefits due from any and all insurance policies, employee benefit plans and/or responsible third-party payers in an amount not to exceed Centura Health's regular and customary charges for the health care services rendered. You authorize such payments from Your insurance carriers, third-party payers, and any other third-parties. You consent to any request for review or appeal by Centura Health to challenge a determination of benefits made by a third-party payer, insurance carrier or employee benefit plan. Except as required by law, You assume responsibility for determining in advance whether the services provided to You are covered by Your insurance or other third-party payer.

Statement to Permit Payment of Medical Benefits to Provider and Physician(s) : You certify that the information You have provided in applying for payment under Title XVIII of the Social Security Act is correct. You authorize any holder of medical or other information about You to release to the Social Security Administration and/or the Medicare Program or its intermediaries or carriers any information needed for this or a related Medicare claim. You request that payment of authorized benefits be made on Your behalf directly to Centura Health and to physicians and groups providing medical care to You.

Additional Terms and Conditions for Apple HealthKit

With Your permission, certain versions of our Applications can connect to Apple HealthKit to receive health information and to share that information with Your healthcare providers.
Our Applications do not share Your health information with HealthKit or with other HealthKit-enabled software.
